Terms of Service
These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and TWC TRAINING & CONSULTANCY SDN. BHD. (Co. No. 202001019701 (1376021-W)), a company registered in Malaysia, trading as WINS Leads ("WINS Leads", "we", "us", "our"), the operator and seller of record of the WINS Leads service. By creating an account, starting a free trial, or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. What WINS Leads is
WINS Leads is a web-based tool that gives you a cleaner interface to manage the leads and contacts you communicate with on WhatsApp — including organising contacts, follow-up reminders, batch follow-up messaging, and a simple sales dashboard. It is designed for individual users and small one-person businesses.
2. Important: WINS Leads is not affiliated with WhatsApp or Meta.
WhatsApp and Meta are trademarks of Meta Platforms, Inc. WINS Leads is an independent product and is not endorsed by, sponsored by, or affiliated with WhatsApp or Meta in any way.
WINS Leads connects to WhatsApp using an unofficial method (a WhatsApp Web–style connection). Using third-party tools with WhatsApp may be contrary to WhatsApp's own Terms of Service and carries a risk that your WhatsApp number could be temporarily or permanently restricted or banned by WhatsApp. We design our features to reduce this risk (for example, by spacing out and personalising messages and capping daily volume), but we cannot and do not guarantee that your account will not be restricted or banned. You use the service at your own risk.
3. Eligibility
You must be at least 18 years old and able to form a binding contract. You must use the service only for your own lawful business or personal lead-management purposes.
4. Your account and your WhatsApp connection
- To use the service you connect your own WhatsApp account by scanning a QR code. You authorise WINS Leads to maintain that connection on your behalf so it can display, organise, send and receive messages through your account.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You are solely responsible for the WhatsApp number(s) you connect and for compliance with WhatsApp's terms in respect of those numbers.
- To save resources, if you do not log in to your dashboard for 14 days, we may automatically disconnect your WhatsApp session. Your data is retained and you can reconnect by logging in again. While disconnected, incoming messages are not captured.
5. Free trial
- We offer a 5-day free trial. The trial is limited to one per customer and is intended to let you evaluate the service before paying.
- No payment method is required to start the trial. You do not enter any card or payment details to sign up, and we cannot and will not charge you during the trial.
- The trial does not convert to a paid plan automatically. When the trial ends, your access is paused until you choose to subscribe. To continue using the service, you actively start a paid subscription and enter your payment details at that point.
- We may modify or withdraw trial offers at any time.
6. Subscription, pricing and billing
- WINS Leads is operated by TWC TRAINING & CONSULTANCY SDN. BHD. (Co. No. 202001019701 (1376021-W)) ("we", "us"), the seller of record for your purchase. The service is offered on a subscription basis, billed monthly or yearly, with payments processed by our payment provider, Stripe. Stripe's terms also apply to the payment transaction. Prices are exclusive of any applicable taxes, which may be added where required by law.
- Subscriptions renew automatically at the end of each billing period using your payment method, until cancelled.
- Founding-member pricing is locked for the life of your continuous subscription. If your subscription lapses, re-subscribing will be at the then-current price.
- We may change prices for new customers and for new subscription terms. We will give reasonable notice of any price change that would affect you.
- If you do not renew, your service is simply paused — there is no penalty.
7. Cancellation and refunds
- You can cancel at any time. Cancellation stops future billing; your access continues until the end of the period you have already paid for, after which the service pauses.
- Because we offer a free trial so you can evaluate the service first, fees already paid are non-refundable, including for partial periods, except where a refund is required by applicable law.
- Nothing in these Terms removes any mandatory statutory consumer rights you may have; where those apply (and where our payment provider is required to honour them), they prevail.
8. Acceptable use
You agree that you will not:
- send spam, or send messages to people who have not agreed to hear from you, or otherwise message contacts without a lawful basis to do so;
- use the service to send bulk or automated messages in a way that violates WhatsApp's terms or any anti-spam, telemarketing, data-protection or other applicable law;
- send unlawful, fraudulent, abusive, harassing, hateful, or infringing content;
- attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the service or other users' data;
- resell, sublicense, or share your account with others.
You are responsible for the messages you send and for obtaining any consent required to contact the people in your account. We may suspend or terminate accounts that breach this section.
9. Your data and content
You retain all rights to your data, including your contacts and messages. As between you and us, you are the controller of your contacts' personal data and we process it on your behalf. You are responsible for having a lawful basis to upload and process that data. To keep the service fast and affordable, chat messages are retained for approximately 14 days and older messages are deleted from our systems (they remain on your phone). Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
10. Service availability and changes
The service is provided on an "as is" and "as available" basis. We do not guarantee that it will be uninterrupted, error-free, or that it will prevent WhatsApp restrictions. We may modify, suspend, add, or remove features, and perform maintenance, at any time.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law:
- The service is provided without warranties of any kind, express or implied, including any warranty that your WhatsApp account will not be restricted or banned, or that data will never be lost.
- We are not liable for any indirect, incidental, special, consequential, or loss-of-profit/business damages, or for any restriction, suspension, or ban of your WhatsApp account, or for loss of data or messages.
- Our total aggregate liability arising out of or relating to the service is limited to the total fees you paid to us in the three (3) months immediately before the event giving rise to the claim.
12. Indemnity
You agree to indemnify and hold harmless WINS Leads from any claims, damages, or costs arising from your use of the service, the messages you send, your breach of these Terms, or your violation of any law or third-party rights (including WhatsApp's terms and the rights of the people you contact).
13. Suspension and termination
We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing the service is not commercially viable. You may stop using the service at any time. On termination, the relevant provisions (including sections 9, 11, 12) survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in the app). Continuing to use the service after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the courts of Malaysia, without prejudice to any mandatory consumer-protection laws of your country of residence.
